1. About This Policy

This Privacy Policy explains how SmarterRoofer.com (“Smarter Roofer,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about you when you visit smarterroofer.com, subscribe to our email list, register for an event, purchase a product, or otherwise interact with us online or offline (collectively, the “Services”). By using the Services, you acknowledge that you have read and understand this Privacy Policy.

 

2. Information We Collect

2.1 Information You Provide Directly

  • Contact and identity information — first and last name, business name, mailing address, email address, and telephone number.
  • Professional information — job title, trade or role, type of contracting work performed, service area, years in business, and similar business details.
  • Account information — username and password, if you create an account.
  • Transaction information — products or services purchased, billing address, and order history. Payment card details are collected and processed directly by our third-party payment processors; we do not store full payment card numbers on our systems.
  • Event and registration information — details you submit when registering for a seminar, workshop, webinar, or training.
  • Communications — the contents of messages, form submissions, survey responses, reviews, comments, podcast questions, and any attachments you send us.

2.2 Information Collected Automatically

When you use the Services, we and our service providers may automatically collect:

  • Internet Protocol (IP) address, browser type and version, operating system, device identifiers, and Internet Service Provider.
  • Referring and exit pages, pages viewed, links clicked, date and time stamps, and general usage patterns.
  • Approximate geographic location derived from IP address (city or region level — we do not collect precise GPS location).
  • Information collected through cookies, pixels, web beacons, and similar technologies (see Section 4).
  • Email engagement data, such as whether you opened an email from us or clicked a link within it.

2.3 Information From Third Parties

We may receive information about you from:

  • Analytics and advertising providers.
  • Social media platforms, if you interact with our pages or accounts.
  • Business data providers and publicly available business directories, from which we may obtain business contact information for commercial outreach.
  • Partners or event co-hosts, where you have provided information to them and they are permitted to share it.

2.4 Sensitive Information We Do Not Collect

We do not intentionally collect Social Security numbers, driver’s license or passport numbers, financial account credentials, precise geolocation, biometric or genetic data, health information, or information revealing race or ethnic origin, religious beliefs, sexual orientation, union membership, or citizenship or immigration status. Please do not submit this type of information to us.

3. How We Use Information

We use the information we collect to:

  • Provide, operate, maintain, and improve the Services.
  • Process, fulfill, and support your orders, registrations, and requests.
  • Respond to your questions, comments, and customer service inquiries.
  • Send transactional messages such as order confirmations, receipts, and event details.
  • Send newsletters, educational content, promotional offers, and other marketing communications you have requested or that relate to products and services similar to those you have obtained from us.
  • Personalize content and measure which content and offers are most useful to our audience.
  • Conduct analytics, understand usage trends, and develop new products, services, and features.
  • Advertise and promote the Services, including through targeted advertising on third-party platforms.

4. Cookies and Similar Technologies

We use cookies and similar technologies for the following purposes:

  • Strictly necessary — enabling core site functions such as navigation, security, form submission, and shopping cart operation.
  • Analytics and performance — understanding how visitors find and use the Site so we can improve it. This may include Google Analytics.
  • Advertising — delivering and measuring advertising on the Site and on third-party platforms, and showing you relevant ads after you leave the Site. This may include Google and Meta advertising technologies.
  • Functional — remembering your preferences and prior information so you do not have to re-enter it.

Third-party advertising and analytics providers set their own cookies and may automatically receive your IP address when their technologies load. We do not control those cookies. Their practices are governed by their own privacy policies, including Google’s advertising policy at https://policies.google.com/technologies/ads.

You can control cookies through your browser settings, and you can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout. If you disable cookies, some features of the Services may not function properly.

 

5. Do Not Track and Universal Opt-Out Signals

Our Services do not currently respond to browser “Do Not Track” signals, because no uniform industry standard for those signals has been adopted.

Where required by applicable state law, we do treat a recognized universal opt-out mechanism — such as Global Privacy Control (GPC) — as a valid request to opt out of the sale or sharing of personal information and of targeted advertising for that browser or device.

 

6. How We Disclose Information

We may disclose the information described above to the following categories of recipients:

  • Service providers and processors who perform functions on our behalf, including website hosting, email delivery, customer relationship management, e-commerce and payment processing, print and direct mail fulfillment, event management, analytics, and IT support. These providers are permitted to use the information only to perform services for us.
  • Advertising and analytics partners, in connection with the technologies described in Section 4.
  • Professional advisors, such as attorneys, accountants, and insurers, where reasonably necessary.
  • Legal and safety recipients — we may disclose information without prior notice when we believe in good faith that doing so is necessary to comply with applicable law, legal process, or a governmental request; to enforce our agreements; to protect the rights, property, or safety of Smarter Roofer, our users, or the public; or to investigate suspected fraud or illegal activity.
  • Business transfers — if all or part of our business or assets is sold, merged, reorganized, or transferred, information about our users may be transferred as part of that transaction. The recipient will be bound by this Privacy Policy unless and until it provides notice of a new policy.

We do not sell your personal information for money. We do not rent or lease our customer lists to unrelated third parties for their own independent marketing.

Some U.S. state privacy laws define “sale” or “sharing” broadly enough to include the disclosure of online identifiers to advertising partners for cross-context behavioral advertising. To the extent our use of the advertising technologies described in Section 4 is treated as a “sale” or “share” under those laws, you may opt out at any time using the methods in Section 12.

We have not knowingly sold or shared the personal information of consumers under 16 years of age.

 

7. Email and Text Message Communications

Email. We may contact you by email with announcements, educational content, promotional offers, alerts, confirmations, and surveys. You may opt out of marketing emails at any time by clicking the “unsubscribe” link in the footer of any marketing email or by contacting us using the details in Section 15. We may still send you non-marketing transactional messages, such as order confirmations and event details.

Text messages. If you provide your mobile number and consent to receive text messages, message and data rates may apply, and message frequency varies. You may opt out at any time by replying STOP; reply HELP for assistance. Consent to receive text messages is not a condition of any purchase. We do not sell or share mobile opt-in consent or telephone numbers with third parties for their own marketing purposes.

 

8. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Privacy Policy — including maintaining your account or subscription, servicing your orders, and communicating with you — and afterward for as long as reasonably necessary to comply with our legal, tax, accounting, and recordkeeping obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete it or de-identify it. Residual copies may persist in backups for a limited period before being overwritten.

 

9. Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, or disclosure. These include the use of encryption in transit (SSL/TLS) for information submitted through our website, access controls, and vendor diligence.

No method of transmission over the Internet or method of electronic storage is completely secure. While we work to protect your information, we cannot guarantee its absolute security, and you provide information to us at your own risk.

 

10. Links to Other Websites

The Services contain links to websites operated by others, including partners, sponsors, and vendors. We are not responsible for the content or privacy practices of those websites. We encourage you to review the privacy policy of any website you visit after leaving ours.

 

11. Children’s Privacy

The Services are intended for business professionals and are not directed to children. We do not knowingly collect personal information from children under 13 years of age. If you believe a child under 13 has provided us with personal information, please contact us using the details in Section 15 and we will promptly delete it.

 

12. Your Privacy Rights

Depending on where you live, you may have some or all of the rights below. These rights are not absolute and are subject to exceptions under applicable law.

  • Right to know / access — request confirmation of whether we process personal information about you and obtain a copy of it, along with the categories collected, the sources, the purposes, and the categories of third parties to whom it was disclosed.
  • Right to correct — request correction of inaccurate personal information.
  • Right to delete — request deletion of personal information we have collected from you.
  • Right to data portability — obtain a copy of your personal information in a portable, readily usable format where technically feasible.
  • Right to opt out — opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising or targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects.
  • Right to limit use of sensitive personal information — as noted in Section 2.4, we do not collect sensitive personal information for purposes that trigger this right.
  • Right to non-discrimination — we will not deny you goods or services, charge you a different price, or provide a different level of quality because you exercised a privacy right.
  • Right to appeal — if we decline your request, you may appeal as described below.

These rights are provided under laws including the California Consumer Privacy Act (as amended by the CPRA) and comparable comprehensive privacy laws in Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, along with additional laws that may take effect in other states.

California “Shine the Light.” California residents may request information about our disclosure of personal information to third parties for those third parties’ direct marketing purposes. We do not currently disclose personal information to third parties for their own direct marketing purposes.

Nevada. Nevada residents may submit a verified request directing us not to sell certain covered information. We do not sell covered information as defined by Nevada law.

How to submit a request. Submit a request using the contact form at https://smarterroofer.com/contact-us or by emailing us at the address in Section 15. To opt out of targeted advertising or any sale or sharing of personal information, you may also send a request through those channels or enable Global Privacy Control in your browser.

Verification. We will take reasonable steps to verify your identity before acting on a request, generally by matching information you provide with information already in our records, or by asking you to respond from the email address associated with your subscription or account. We may decline requests we cannot reasonably verify. An authorized agent may submit a request on your behalf with written authorization and proof of identity.

Timing and appeals. We will respond within 45 days, and may extend that period by an additional 45 days where permitted, with notice to you. If we decline your request, you may appeal by replying to our response or contacting us within 45 days. We will respond to an appeal in writing within 45 days (or 60 days where the applicable state law provides).

 

13. Users Outside the United States

The Services are intended for users located in the United States. Information we collect is stored and processed in the United States, and by using the Services you understand that your information will be transferred to and processed in the United States, which may have different data protection rules than your country of residence.

 

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will revise the “Last Updated” date below and, where appropriate, provide additional notice by posting a prominent notice on the Site or emailing the address associated with your subscription or account. Your continued use of the Services after the effective date of a revised policy constitutes acceptance of it.
